Layoff Sequence Given in A&R Contract

Agency One gives John a notice of termination of position.

John laterally displaces Mary, the least senior person in his job class in his agency.

Mary laterally displaces Dan, the least senior person in her job class statewide (in a different agency).

Dan’s only option is to leave his agency, go to Agency One and bump down in his job class  series, or into a job class deemed “comparable” (there is a list). NOTE: THE 1,100 SINGLE SALARY GROUP UPGRADES IN 2007 HAS LED TO SOME CLASSES HAVING THE SAME SALARY GROUP AS CLASSES WHICH THEY CAN BUMP INTO. THIS IS BEING REVIEWED. If Dan can bump into Agency One, the person he bumps is laid off. If there is no one he can bump in Agency One, Dan is laid off. Paragraph modified 07/21/11.

Note #1: No one can laterally displace or bump anyone who has more layoff seniority (total time ever served in A&R) than they have. For example, a supervising accountant couldn't bump an assistant accountant if the assistant accountant had more layoff seniority.

Note #2: The union believes that the person Dan bumps can laterally displace the least senior person in his/her job class statewide and the process repeats. So far, two arbitrators have disagreed with us.

 

What is a Key Person?

A key person is designated as such by the management of an agency. A key person is protected from being laterally displaced by someone in the same job class from another agency.  (In the layoff sequence above, if Dan was a key person Mary would have had to laterally displace the second least senior person in her job class  statewide).

See the formula in Article 13, Section Two for the number of key persons to which an agency is entitled. There is a key person list compiled each April.

A key person can be laterally displaced or bumped by someone in their own agency. A key person can can be bumped by someone from another agency. The key person is only protected from being laterally displaced by someone in the same job class from another agency.
